Although this is a strict liability offence (in other words if you have no insurance you have no defence and the Court will impose 6-8 points and fine you too) there may be legal exceptions to this e.g. you were driving your employer’s vehicle and he was responsible for the insurance or the insurance may be voidable by the insurance company and not void (meaning you were technically insured and, therefore, not guilty). Even if you are guilty of driving without insurance, I may well be able to persuade the Court that there are ‘Special Reasons’ for not endorsing your licence with points e.g. a person you trusted, such as your father, was responsible for the insurance and led you to believe you were insured. There are many different circumstances that could amount to Special Reasons – I can give you specialist advice on what could or could not amount to Special Reasons.
